Terms of Service

Terms of Service

Effective date: May 13, 2026

These Terms govern your access to and use of The Zeroth website, console, desktop application, account features, downloads, and billing services.

The Zeroth is operated by an independent individual developer. Until a legal entity is formed, references to The Zeroth, we, us, or our mean the individual operator of the product.

By using The Zeroth, you agree to these Terms. If you do not agree, do not use the service.

01

The service

The Zeroth provides a desktop-first environment for running AI workflows, managing account-based desktop access, viewing usage or entitlement state, and managing subscriptions.

The desktop app can connect directly to OpenRouter or other configured model providers from the client. The Zeroth does not guarantee availability, pricing, behavior, or output quality of third-party model providers.

02

Accounts and security

You are responsible for maintaining the security of your account, devices, OAuth grants, provider keys, and local desktop environment.

You must not share access tokens, attempt to bypass account checks, interfere with authorization flows, or use another user's account without permission.

03

Subscriptions and billing

Paid plans, renewals, cancellations, quota packs, and payment failures are handled through the billing flow shown in the console or by our payment provider.

Monthly subscription quota is valid only for the subscription billing period in which it is granted and does not roll over after that period ends.

Quota packs may be purchased multiple times. Quota granted through quota packs does not expire while your account remains active, unless we disclose a different rule at checkout or must change access for legal, security, fraud, or abuse reasons.

Plan features, pricing, capacity, and availability may change. We will try to provide reasonable notice for material changes when practical.

Unless required by law or expressly stated at checkout, subscription payments and quota pack purchases are not refundable after purchase or renewal.

Taxes, refunds required by law, chargebacks, failed payments, and payment disputes may be handled by the payment provider and applicable law.

04

AI outputs and user responsibility

AI-generated outputs can be inaccurate, incomplete, unsafe, or inappropriate for your intended use. You are responsible for reviewing and validating outputs before relying on them.

The Zeroth is not a substitute for professional legal, medical, financial, security, or engineering judgment.

05

Your content and provider use

You retain your rights in content you create, load, or process through your workflows.

In the current production setup, when the desktop app sends requests directly to OpenRouter or another model provider, that provider may process your content under its own terms. You are responsible for ensuring you have the rights and permissions needed to send that content.

06

Eligibility

You must be able to enter into a binding agreement in your jurisdiction. If you are under the age of majority, you may use The Zeroth only with involvement and consent from a parent or legal guardian.

If you use The Zeroth for an organization, you represent that you have authority to accept these Terms on behalf of that organization.

07

Acceptable use

You may not use The Zeroth to violate law, infringe rights, distribute malware, attack systems, bypass quotas, scrape or overload the service, reverse engineer protected components, or abuse authentication, billing, or provider integrations.

We may suspend or terminate access if we believe use of the service creates legal, security, operational, or abuse risk.

08

Third-party services

The service depends on third-party services such as Clerk, Google OAuth, payment providers, hosting providers, OpenRouter, and selected model providers. Their terms and privacy policies may also apply.

We are not responsible for third-party services outside our control.

09

Availability and changes

The service may change, pause, or become unavailable. We do not promise uninterrupted or error-free operation.

We may update desktop releases, backend services, billing behavior, or account flows to improve security, reliability, or product functionality.

10

Disclaimers and liability

The service is provided as is and as available, without warranties to the maximum extent permitted by law.

To the maximum extent permitted by law, The Zeroth will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption.

11

Governing rules

These Terms are governed by applicable law for the individual operator's place of residence, except where consumer protection law gives you mandatory rights in your own jurisdiction.

Before starting a formal dispute, you agree to contact us at legal@the-zeroth.com so we can try to resolve the issue informally.
